TICKET OFFICE REGULATION ON LINE SALES

A. TERMS AND INFORMATION

  1. Travelers are obliged to respect the herein regulations and to observe the provisions issued by relative authorities and employees of the company Funivie Monte Bianco S.p.A. in order to guarantee safety and regularity of operations.
  2. Violations of the ticket office rules and the above will bring about the immediate withdrawal of your ticket and legal sanctions will be applied, in particular those of the Valle d’Aosta Regional Law no. 20 dated 18 April 2008 and the Presidential Decree no. 753 dated 11 July 1980.
  3. Purchasing a ticket implies that all the terms established in the herein regulations which are posted in the ticket offices and published on the website www.montebianco.com for public reading are known and accepted.
  4. Before purchasing the ticket, the client must find out about the range of tickets available and the rate reductions that can be applied.
  5. Purchasing a ticket implies knowledge and acceptance of the herein ticket office regulations, people transportation regulations and all safety conditions.
  6. A complaints register for all users who wish to report faults, complaints about service or simply make suggestions to improve the service is available at the ticket offices.
  7. Privacy policy for online purchases.

B. TARIFFS

All tariffs are usually applicable for the entire season. They can, however, be amended at any time when there are notable variations to the cost of living or taxation or other important facts.
Prices shown in the tariffs are in Euro and include VAT rates effective at the time of purchase.

C. SPECIAL TARIFFS

  1. The declared subsidies can be verified by controllers by requesting to see the necessary documentation.
  2. The Baby free tariff (under the age of 8) is granted exclusively to children up to the age of 7, on tickets specifically indicated in the company lists of tariffs and which can only be purchased if an adult buys a ticket at the same time and for the same duration, otherwise, the under 18 tariff will be applied.
  3. The under-18 tariff is applicable for boys and girls from 8-17 years of age.
  4. The family tariff is applicable if the family comprises 2 adults and 2 or more children under 18 years old (8-17 years old).

D. TICKET VALIDITY

All tickets are transport documents and are also valid as legally-valid receipts (Min Decree 30.06.1992) and must be retained for the entire duration of the journey. They are valid during normal working hours of the Funivie Monte Bianco S.p.A. lifts open to the public.
Purchasing a ticket only gives the right to use the corresponding lifts, for the routes stated, on the days on which the ticket is valid and according to the normal numbers of travelers at the starting point.
Funivie Monte Bianco S.p.A. asks the compulsory booking of the cable car departure. This reservation can be done on the website www.montebianco.com following the video instruction or directly at the ticket office in fixed timetable.
The company reserves the right to establish a part-precedence service for certain special categories of users.
Tickets also give the purchasers the right to transport mountain equipment with them, and also a small bag. The transportation of other items must be agreed beforehand with the company within the limits of the current legislation and regulations in force.

E. USE OF TICKETS

  1. All the tickets are strictly personal and not transferable. Any misuse will bring about immediate withdrawal, the application of sanctions as provided for by law and reporting to the competent authorities.
  2. No reimbursements can be made except in the cases where the tickets cannot be used due to the fact that the lifts are not operational due to technical reasons, adverse weather conditions or official reasons.
  3. Customers must check when purchasing the ticket that the type and price of the ticket correspond to the one requested.

F. ONLINE PURCHASES

Funivie Monte Bianco S.p.A. tickets can be purchased online using the credit card on the website www.montebianco.com or via links connected with the website.
Only ticket document listed can be purchased, 24/7, except for temporary interruptions – also without prior notice – due to technical reasons that are not caused by the company for any reason.
The company is not responsible for all the problems deriving from use of the internet due to the interruption of services or the presence of computer viruses and all other cases that jurisprudence would define as “force majeure”.
Refusal of payment by the customer’s bank will bring about the cancellation of the purchasing process.
When the purchase is done, the client will receive the tickets by mail in digital format and, at the gates, they can be used by smartphone or tablet: they value as a purchase receipt and the cable car employees may ask the clients to show them together with an ID card in case of promotional rate.

H. CARTE RESIDENT

Tickets sold at special rates for residents in Valle d’Aosta cannot be purchased online.

I. CONTROLS

The purchaser must produce the ticket on request from any authorized supervising staff from the company Funivie Monte Bianco S.p.A.
Any relative documentation must be produced if tickets were sold at special discounted rates.

For any matters not regulated here, please refer to the regulations and notices exhibited in the ticket offices and on the lifts.


MERCHANDISING - TERMS AND CONDITIONS

Clause 1 – General provisions

1. By browsing this area, users access the FUNIVIE MONTE BIANCO S.p.A. online shop, accessible via the URL: https://montebianco.skiperformance.com/. Browsing and transmitting a purchase order on the website imply acceptance of the Terms and Conditions and Data Protection Policies adopted by and indicated on the website itself.

2. These General Terms and Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the website in accordance with the provisions of Part III, Title III, Chapter I of the Italian Consumer Code (Italian Legislative Decree no. 206/05 amended by Italian Legislative Decree no. 21/14 and Italian Legislative Decree 70/03) by

3. Before accessing the products supplied by the website, users are required to read these General Terms and Conditions of Sale which are generally and unequivocally accepted at the time of purchase.

4. Users are invited to download and print a copy of these General Terms and Conditions of Sale, whose terms FMB reserves the right to modify unilaterally and without notice. Any changes are not, however, effective for customers who have already placed an order.

5. It is possible to use the website and, therefore, access products supplied by it and purchase them, in the following languages: Italian, English, French.

Clause 2 – Subject

1. These General Terms and Conditions of Sale govern the offer, placing and acceptance of purchase orders for products on FMB.

2. The FMB e-commerce business is exclusively aimed at end users who have reached the age of 18 and who are “Consumers”. “Consumers” are the natural and legal persons who act on https://montebianco.skiperformance.com/ with purposes not related to any commercial, entrepreneurial or professional activity of their own.

Clause 3 – Entering into the contract

1. In order to enter into the purchase contract, it will be necessary to complete the purchase process, paying using one of the available methods (credit card, PayPal).

2. The purchase process contains the acceptance of the General Terms and Conditions of Sale, the images of each product and the relative price, the payment methods that can be used, the delivery methods for the purchased products (shipping and collection), a reference to the conditions for exercising the right of withdrawal; methods and timeframes for returning the products purchased.

3. Before entering into the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale, including the information on the right of withdrawal and the processing of personal data. The order confirmation implies the acceptance of these general terms and conditions by the Purchaser. These conditions may be updated or modified directly with the new rule being featured on this website. The modification or update will be valid and effective for orders that have not yet been finalised.

4. The purchase contract ends with the confirmation of payment. For the Purchaser, therefore, the purchase becomes definitive once the order has been finalised, without prejudice to the right of withdrawal and to change their mind referred to in Clause 11. Upon receipt of the order, the Seller will send a printable e-mail confirmation and summary of the order itself, which will contain the data entered by the purchaser.

5. Once the contract has been entered into, the seller takes charge of the order to process it.

Clause 4 – Registered users

1. In completing the registration procedures, users undertake to follow the instructions on the website and to provide their data correctly and truthfully.

2. The confirmation will in any case relieve FMB of any liability regarding the data provided by users. Users undertake to promptly inform FMB of any variation in the data they have provided at any time.

3. If users then provide inaccurate or incomplete data or even in the event that there is a dispute by the interested parties regarding the payments made, FMB will be entitled to suspend or not activate the service until the related deficiencies are rectified.

Clause 5 – Product availability

1. Product availability refers to actual availability at the time the purchaser places the order.

2. Even after sending the order confirmation e-mail, there may be cases in which goods are partially or totally unavailable. In this case, the order will be automatically corrected with the elimination of the unavailable product and the purchaser will be immediately informed by e-mail.

Clause 6 – Products offered

1. FMB sells various merchandising products (souvenirs, clothing, cosmetics etc.)

Clause 7 – Payment methods and prices

1. The price of the products will be that indicated at the time on the website.

2. Website prices include VAT and shipping costs for deliveries exclusively in Italy.

3. Once the desired products have been selected, they will be added to the basket. It will be sufficient to follow the instructions for the purchase, entering or verifying the information requested in each step of the process. Order details can be changed before payment.

4. Payment can be made by:
- Credit cards (VISA, Mastercard, Maestro, AMEX)
- PayPal

Clause 8 – Delivery

1. FMB will only deliver to the address specified by the user during the purchase.

2. Delivery is only available in Italy, generally within 4-7 working days, or, if no delivery date is specified, within the maximum term of thirty days.

3. Delivery to EU and non-EU countries is not currently available. Purchases may be collected at the FMB headquarters, Strada Statale 26 dir. N.48 11013 COURMAYEUR (AO) ITALY.

4. If delivery is not possible, the order will be sent to the carrier’s warehouse. In this case, a notice will specify the place where the order is located and how to arrange a new delivery according to the procedure used by the courier.

5. If the delivery cannot take place for reasons not attributable to us after thirty days from the date on which the order is available for delivery, we will assume that the intention is to terminate the contract.

6. As a result of the termination, the amounts will be returned, with the exclusion of additional costs deriving from the termination of the contract – consisting of transport costs for the return to the FMB warehouse – which will be borne by the purchaser.

7. Shipping costs are paid by FMB, with the exception of transport costs for contract termination, which will be borne by the purchaser.

Clause 9 – Passing of risk

1. The risks relating to the products will pass to the purchaser from the moment of delivery. The ownership of the products is considered acquired as soon as the complete payment of all amounts due in relation to the same has been received, or at the time of delivery, if this occurs at a later date.

2. Upon receiving the products, the customer must check that the package is perfectly sealed and intact. If the package is damaged, the customer must report the disputes to the courier. If this does not occur, the products are considered to have been properly delivered.

Clause 10 – Warranty and commercial compliance

1. The seller is responsible for any defect in the products offered on the website, including the non-conformity of the items with the products ordered, in accordance with the provisions of Italian law.

2. In the event of non-conformity, any purchaser who has entered into a contract as a consumer will have the right to obtain the restoration of the conformity of the products free of charge, by means of replacement, or to obtain the termination of the contract relating to the disputed goods with the consequent reimbursement of the price paid.

Clause 11 – Withdrawal

1. In accordance with the legal provisions in force, the purchaser has the right to withdraw from the purchase without any penalty and without specifying a reason, within 14 days pursuant to Article 57 of Italian Legislative Decree 206/2005 starting from the date of receipt of the products.

2. Any user who intends to exercise their right of withdrawal from the purchase may access the “Returns” section and fill in the appropriate form.

3. The purchaser must exercise the right of withdrawal by sending the appropriate form filled in correctly as per the previous point to the e-mail address: shop@montebianco.com

4. The goods must be returned intact, in the original packaging complete in all their parts. Without prejudice to the right to verify compliance with the above, FMB will refund the amount of the products subject to withdrawal within a maximum period of 14 days, including any shipping costs.

5. The site will make the refund using the same payment method chosen by the purchaser during the purchase or, if this is not possible, by bank transfer to a current account in the name of and indicated by the user.

6. No exchanges are envisaged. If you wish to exchange a product, changing colour, size etc., you need to request a return and make a new purchase.

1. The purchaser’s data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the specific section containing the information pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 (Privacy Policy).

Clause 14 – Applicable law and jurisdiction

1. These General Terms and Conditions of Sale are governed by Italian law and interpreted on the basis of it.

2. Any disputes inherent and/or consequent to said terms and conditions must be resolved exclusively by the Italian judicial authority. In particular, if the purchaser qualifies as a Consumer, any disputes must be resolved by the court of their place of domicile or residence according to the applicable law.
